GENERAL TERMS AND CONDITIONS OF SALE
Preamble and Brand Independence
These General Terms and Conditions of Sale govern distance purchases of products and services made via the e-commerce platform accessible at the official domains www.lvdue.com, www.lvdue.it, and www.lavespadue.it (hereinafter collectively referred to as the "Site"), managed by LVDUE s.r.l. (hereinafter "LVDUE"), with registered office at Via San Domenico 10, 80044 Ottaviano (NA), Italy.
Declaration on Trademarks, Independence, and Product Compatibility
- Independence from third-party trademarks: LVDUE s.r.l. is an independent company and is in no way affiliated with, connected to, authorized by, licensed by, sponsored by, or endorsed by Piaggio & C. S.p.A. or any other trademark owners mentioned on the Site.
- Descriptive use of trademarks: Trademarks, trade names, logos, and references to vehicle models (including, by way of example, Piaggio, Vespa, Gilera, Derbi, etc.) featured on the Site belonging to third parties are used solely and exclusively for descriptive purposes to indicate the intended use, technical function, and compatibility of the spare parts and accessories sold (pursuant to Article 21 of Legislative Decree 30/2005 - Italian Industrial Property Code).
- Nature of the Products: Unless explicitly and clearly stated otherwise within the individual product listing, all products sold on the Site are to be understood as NON-ORIGINAL, but fully COMPATIBLE/ADAPTABLE spare parts for the indicated vehicles. An item is considered ORIGINAL solely and exclusively when the relative product listing contains the explicit wording "ORIGINAL" and specifies the vehicle manufacturer as the manufacturer (e.g. Piaggio). In the absence of such specific indications in the product listing, the product is strictly and exclusively deemed to be compatible and manufactured by third parties.
N.B. Racing and Track Use: Several items sold on the Site are intended exclusively for Racing, Competition, Collection use, or for use on circuits, race tracks, and private non-traffic areas. The Customer is responsible for verifying current road circulation laws and regulations before using such spare parts on public roads and areas. LVDUE disclaims all liability for improper or non-compliant use of the products sold.
1. Acceptance of the General Terms and Conditions of Sale
1.1 The contract concluded between LVDUE and the Customer is deemed concluded upon acceptance, even partial, of the order by LVDUE. Such acceptance is deemed tacit unless otherwise communicated in any manner to the Customer. By placing an order through the various methods provided on the Site, the Customer declares to have reviewed all information provided during the purchase procedure and to fully accept these general terms and payment terms.
1.2 If the Customer is a Consumer (i.e. a natural person purchasing goods for purposes unrelated to their professional or business activity), once the online purchase procedure is completed, they shall print or save an electronic copy and retain these general terms and conditions of sale, in compliance with Articles 49 et seq. of Legislative Decree 206/2005 (Italian Consumer Code) on distance sales.
1.3 Any right of the Customer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order due to proven operational or logistical reasons.
2. Purchase Methods, Product Listings, and Availability
2.1 The Customer may only purchase products present in LVDUE's electronic catalogue at the time the order is submitted, as described in the relevant information sheets. It is understood that images accompanying the descriptive listings are for illustrative purposes and may not fully represent the exact color, size, or accessories shown.
2.2 Each item listing indicates the manufacturer's brand of the spare part and its technical specifications. References to vehicle models (e.g. "compatible with Vespa...") serve exclusively to identify the technical application of the part.
2.3 Correct receipt of the order is confirmed by LVDUE via email to the address provided by the Customer. This confirmation message will include the date, execution time, and a "Customer Order Number" to be used in all subsequent communications. The Customer undertakes to verify the accuracy of the data and promptly communicate any corrections.
2.4 Product Availability: Availability indicated on the Site is continuously updated. If, due to simultaneous sales across multiple channels or an unforeseen inventory misalignment, an ordered item becomes unavailable, LVDUE will promptly inform the Customer by email or phone, refunding in full and as quickly as possible (and in any case within 14 days) any amounts already paid for the missing item.
3. Payment Methods and Prices
3.1 Prices listed on the Site are expressed in Euros (€) and are inclusive of VAT. Payments relating to orders must be made within 5 business days of placing the order. Once this deadline passes without receipt of payment or proof thereof, the order may be cancelled.
Accepted payment methods:
- Advance Bank Transfer: The order will be processed upon actual credit to our bank account (averaging 1-3 business days). Bank details and reference instructions are provided upon order completion.
- Credit / Debit Card (via Payment Gateway / GestPay / Stripe / PayPal): Secure and immediate payment with redirection to the secure servers of the chosen banking institution or circuit.
- PayPal: Secure and immediate payment via your PayPal account or linked card.
- PostePay Top-up: Available for domestic purchases within Italy with immediate processing.
For international orders, payments are accepted exclusively via Bank Transfer, Credit/Debit Cards, and PayPal. For bank transfers made by third parties, the order number and name of the purchaser must be specified in the transfer reference.
4. Delivery Methods and Shipping Costs
4.1 For every order placed on the Site, LVDUE issues an official tax document (Receipt or Electronic Invoice). To issue an Electronic Invoice (reserved for VAT identification number holders or private individuals who explicitly request it at the time of ordering), the Customer must provide complete tax details (Fiscal Code/Tax ID, VAT number if applicable, Recipient SDI Code, and/or PEC email). The request for an invoice must be made simultaneously with the order or prior to the shipment being dispatched.
4.2 Delivery charges, unless otherwise specified or during free shipping promotions, are borne by the Customer and are explicitly detailed and highlighted prior to order confirmation.
4.3 LVDUE undertakes to hand over the goods to the carrier as quickly as possible. Any delivery delays attributable to the carrier or force majeure events cannot be charged to LVDUE.
4.4 Unless explicitly stated otherwise, delivery is intended at street level. Upon delivery of the goods by the courier, the Customer is required to check:
- That the number of packages corresponds to what is indicated on the transport document;
- That the packaging is intact, undamaged, not wet, or otherwise altered, including sealing materials (e.g. custom LVDUE adhesive tape).
Important: Any damage to the packaging and/or product must be immediately reported by stating "SPECIFIC SUBJECT TO CHECK" on the courier's delivery slip (e.g. "Subject to check due to crushed/wet package/tampered seal"). Subsequently, the Customer must inform LVDUE within 7 days via email to info@lavespadue.it attaching photo documentation.
4.5 In case of non-delivery due to repeated absence of the recipient or incorrect address details resulting in storage at the courier's warehouse, the goods will return to LVDUE's warehouse. To arrange a second dispatch, storage and re-shipping costs will be charged to the Customer.
5. Right of Withdrawal (Articles 52 et seq. of Legislative Decree 206/2005 - Italian Consumer Code)
5.1 If the Customer is a Consumer (a natural person purchasing goods for purposes unrelated to their professional activity or who does not provide a VAT number in the order), they have the right to withdraw from the purchase contract without giving any reason and without penalty, within 14 calendar days from the date of receiving the goods.
5.2 To exercise the right of withdrawal, the Customer must inform LVDUE of their decision through an explicit statement prior to the expiration of the 14-day period. Communication can be sent via email to info@lavespadue.it or by registered mail with return receipt addressed to:

5.3 Upon receiving the notice, LVDUE will provide the Customer with instructions for returning the merchandise. The Customer must send back the products within 14 days from the date on which they communicated their decision to withdraw.
5.4 Conditions of Withdrawal:
- The right applies to the purchased product in its entirety (partial withdrawal on individual components of a kit is not permitted);
- The product must be returned intact, complete in all its parts (original packaging, documentation, accessories, manuals) and free from signs of use, assembly, or wear that impair its resale value;
- By law, direct shipping costs for returning the item are borne by the Customer, unless otherwise specified or in the case of product non-conformity;
- The return shipment is under the Customer's responsibility until receipt is acknowledged at LVDUE's warehouse.
5.5 Refund: Subject to any restoration costs for verified damage to the product, LVDUE will refund all payments received from the Customer (including basic delivery costs) within 14 days from the moment it is informed of the decision to withdraw. LVDUE reserves the right to withhold the refund until it has received the goods or until the Customer demonstrates that they have sent back the goods. Refunds will be issued using the same payment method used by the Customer for the initial transaction.
6. Legal Warranty of Conformity
6.1 All products sold by LVDUE to Consumer customers are covered by the Legal Warranty of Conformity lasting 24 months from delivery, pursuant to Articles 128 et seq. of the Italian Consumer Code. For purchases made with a VAT number (business entities/professionals), the statutory warranties provided by the Italian Civil Code apply (Articles 1490 et seq. of the Civil Code, lasting 12 months).
6.2 To claim warranty support, the Customer must retain proof of purchase (invoice, receipt, or transaction record). The warranty applies to products presenting a conformity defect, provided the product has been used correctly, in compliance with its intended use and technical documentation provided.
6.3 In the event of an established lack of conformity, the Customer is entitled to have product conformity restored through repair or replacement at no cost, or to an appropriate price reduction, or termination of the contract.
6.4 The warranty does not cover defects resulting from:
- Negligence, misuse, incorrect or improper installation/assembly not carried out in accordance with proper workmanship standards;
- Tampering or technical interventions carried out by unauthorized personnel;
- Normal wear and tear of components subject to degradation over time.
7. Personal Data Processing (Privacy)
7.1 Personal data requested during ordering is collected and processed in compliance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 as amended, for order management, invoicing, shipping, and compliance with legal obligations.

8. Complaints and Customer Support
8.1 Any formal complaint or request for assistance may be sent to LVDUE s.r.l. via email to info@lavespadue.it or by registered letter with return receipt to:

9. Applicable Law and Jurisdiction
9.1 The contract of sale between the Customer and LVDUE is deemed concluded in Italy and is governed by Italian Law.
- For disputes arising from contracts concluded with a Consumer, mandatory territorial jurisdiction belongs to the Court of the location of residence or domicile of the consumer, provided it is located within the territory of the Italian State (Article 66-bis Italian Consumer Code).
- For purchases made by entities with a VAT number / Professionals, exclusive jurisdiction is assigned to the Court of Salerno (SA), Italy.
These General Terms and Conditions of Sale remain valid and effective until modified and/or updated by LVDUE s.r.l. Any amendments will be effective from the date of publication on the Site.
